Terms & Services.

The ground rules for our website, managed marketing services, and client CRM. Clear expectations for the work we do together.

On this page
Your service agreement comes first. Your accepted proposal, order form, or signed services agreement sets the scope, price, advertising budget, and subscription terms for your business. These general terms do not create a purchase or permission to charge you simply because you visit our website.

Who these terms cover

These Terms and Conditions (the “Terms”) describe the rules for dashmediaco.com, Dash-branded client portals, and related marketing and CRM services (the “Services”). “Dash,” “we,” and “us” refer to Dash Media Co. “You” means the visitor or business customer and its authorized users, as applicable.

The Services are intended for business use by people who are at least 18 and legally able to enter a contract. Anyone accepting on behalf of a business must have authority to bind that business. Paid Services require an accepted order or another affirmative agreement; a consultation request alone is not a purchase.

For purchased Services, these Terms apply when expressly incorporated into your order or affirmatively accepted during onboarding. If there is a conflict, a signed data processing agreement controls data processing, and your accepted service agreement controls its subject matter, followed by these Terms. Terms cannot waive rights or obligations that applicable law does not permit the parties to waive.

What Dash provides

Depending on your order, Dash may provide campaign strategy, advertising creative, paid advertising management, landing pages, qualification funnels, phone verification features, lead delivery, CRM access, messaging tools, and automated follow-up. Only the deliverables and features included in your order are purchased. Additional work, integrations, and support arrangements require agreement.

Dash markets its Services to mortgage professionals. A lender client's campaigns may separately collect inquiries from prospective borrowers. A request on Dash's own consultation page requests contact about Dash's business Services; it does not submit a mortgage application or reserve a calendar appointment unless a booking confirmation says otherwise.

Dash provides marketing and technology services. The Services do not make Dash your lender, mortgage broker, loan originator, underwriter, legal adviser, or fiduciary. Your licensed business makes lending decisions and provides its own regulated advice and disclosures.

Protect your account

Provide accurate account information, keep it current, and give access only to authorized personnel. Use unique credentials and available multifactor authentication. Do not share passwords, bypass location permissions, or attempt to access another customer's records. Tell Dash promptly if you suspect unauthorized access and cooperate in containing it.

You are responsible for user permissions and activity by people you authorize, except to the extent caused by Dash's breach of its obligations. Client access is a limited, nonexclusive permission to use the subscribed Services for your business during the agreed term. It does not transfer ownership of the underlying software or grant a right to resell access.

Approvals and client responsibilities

You must supply timely, accurate business information, necessary access, approved branding, required regulatory disclosures, and substantiation for claims about your products or business. You authorize Dash to use those materials and connected accounts only to carry out the agreed Services. Dash will operate within the agreed campaign scope and budget; a material budget increase requires your authorization.

You are responsible for the accuracy and legal approval of client-supplied rates, loan programs, eligibility statements, testimonials, licenses, and disclosures. Dash remains responsible for its own work and legal obligations. Approval of creative does not excuse either party's unlawful conduct. Tell us promptly if a claim, license, product, or offer changes.

Missing approvals, unavailable account access, ad review, carrier registration, and payment issues may delay a launch. We will communicate material delays we become aware of. Your team is responsible for responding to inquiries, maintaining accurate pipeline records, and delivering the services advertised.

What a lead does and does not mean

A lead is an inquiry or contact record collected through an agreed campaign or funnel. “Qualified” means it meets the screening criteria expressly agreed for that campaign. “Phone verified” means a verification process confirmed access to a phone number at that time. It does not establish identity, creditworthiness, purchasing power, loan eligibility, or permission for every kind of outreach.

People may provide inaccurate information, change their plans, fail to respond, or contact other providers. Unless your order expressly promises otherwise, lead exclusivity, a particular replacement policy, and a minimum lead quantity are not included. Tell Dash about suspected duplicates, invalid records, or delivery problems so they can be investigated under your agreed criteria.

No particular commercial outcome is guaranteed. Costs, volume, appointments, conversion rates, loan approvals, funded loans, revenue, and return on advertising spend depend on factors outside a campaign alone. Examples, projections, and past results are not a promise of your results. Any express commitment in your signed agreement remains enforceable under that agreement.

Fees, advertising spend, and refunds

Your accepted order states service fees, setup charges, payment dates, applicable taxes, and any subscription or usage charges. Advertising spend and third-party charges are separate from Dash's service fee unless expressly included. You must authorize the budget and payment method before spend is incurred. Usage can include phone numbers, calls, texts, email, AI features, or other metered services, as disclosed in your order.

Recurring billing, renewal periods, cancellation deadlines, minimum commitments, refunds, and lead credits apply only as disclosed and agreed when you purchase or renew. These Terms do not independently authorize automatic renewal, impose a cancellation fee, or make every payment nonrefundable. Contact Dash promptly about a billing error; we will review it in good faith. This does not limit statutory dispute rights.

Ad platforms and other providers may bill you directly and apply their own refund rules. Dash cannot promise recovery of money already spent with them. Unspent funds held by Dash must be accounted for at cancellation and handled under your agreement and applicable law. You remain responsible for properly incurred, authorized charges and Services already provided.

Consent, calling, texting, and email

Before launching outreach, the parties must identify the sender, intended recipients, message purpose, consent basis, and responsible operator. You must have the permissions needed for contacts you import or direct us to contact, keep evidence of those permissions, and honor channel restrictions. A purchased list, a lead record, a phone verification code, or acceptance of these Terms is not by itself marketing consent.

Campaigns must comply with applicable calling and messaging laws, do-not-call requirements, email rules, registration requirements, quiet hours, and carrier policies. Do not use misleading sender information, conceal the advertiser, bypass suppression lists, or send communications after an applicable opt-out. Each party remains responsible for the activities it performs; outsourcing does not remove legal obligations.

When you separately opt into a Dash text program, it may send the types of messages described at opt-in, such as requested consultation follow-up or account support. Frequency varies; message and data rates may apply. Reply STOP to end that program's texts or HELP for assistance. Consent is not a condition of buying Services. You may also request help through the contact options below. Delivery is not guaranteed, and carriers are not liable for delayed or undelivered messages. This paragraph does not enroll you or authorize unrelated borrower outreach.

Keep regulated activity with licensed professionals

Client lenders are responsible for maintaining the licenses and authority needed for their products, personnel, and service territories, and for approving required NMLS identifiers, lending disclosures, and product claims. Neither party may use the Services for deceptive mortgage advertising, unlawful discrimination, steering, or targeting that violates fair lending or fair housing requirements.

Marketing fees must be for actual, lawful services and must not disguise a payment for prohibited settlement-service referrals, fee splitting, or a required use of a provider. Neither these Terms nor a “lead” label makes an arrangement lawful. The parties must review the substance of any arrangement subject to RESPA or similar restrictions before launching it.

The marketing CRM is not a substitute for your approved loan application, underwriting, or secure document system. Do not submit Social Security numbers, bank credentials, full payment card details, credit reports, or similarly sensitive borrower documents through marketing forms or ordinary messaging unless a separately approved secure workflow and appropriate written safeguards are in place.

Your records and confidential information

As between you and Dash, you retain rights to your client-supplied materials and business contact records, subject to individuals' privacy rights, consent limits, and any third-party rights. You grant Dash permission to process those materials only as reasonably necessary to deliver and secure the Services, follow your lawful instructions, and meet legal obligations. These Terms do not grant Dash a general right to sell your contact lists or reuse them for another client's campaigns.

Each party must use reasonable safeguards, restrict access to people and providers who need it for the agreed purpose, and protect the other's nonpublic business information. These confidentiality duties do not cover information lawfully public, already known without restriction, independently developed, or lawfully received from another source. Legally required disclosures are permitted, with notice when lawful.

The parties must establish appropriate privacy notices, data processing terms, and security requirements for their actual roles before processing personal data. These Terms are not a substitute for a privacy policy, a required data processing agreement, or a consent notice. Contact Dash about privacy requests or a suspected data incident through the options below; each party will cooperate with legally required incident response.

You should keep appropriate backups and export business records you need to retain. Dash will reasonably assist with an authorized export in available standard formats, subject to security verification, legal duties, technical availability, and agreed migration charges. Cancellation does not transfer another customer's information or a provider's software, and does not authorize indefinite data retention.

Creative, software, and brand rights

You retain your business name, trademarks, and materials you supply. Ownership or ongoing use rights in client-specific creative, landing pages, and other paid deliverables are defined in your order. If the order does not specify ownership, it must be clarified in writing before delivery; these Terms do not silently transfer your rights to Dash.

Dash and its licensors retain their preexisting templates, reusable methods, tools, platform software, and improvements of general application. Using a customized CRM or a Dash subdomain does not give you ownership of that software or the Dash domain. Third-party licensed components remain subject to their disclosed licenses. Dash may not use your name, logo, or results in a public case study without your permission.

Use the Services lawfully

Do not use the website or Services to commit fraud, impersonate others, violate intellectual property or privacy rights, harass people, distribute malware, send unlawful spam, exploit children, or promote unlawful discrimination. Do not upload data you lack permission to use, evade access controls or provider restrictions, disrupt systems, scrape private records, or reverse engineer software except where applicable law expressly permits it.

Cooperate with reasonable, lawful inquiries about abuse, account security, or communications compliance. Dash may restrict the affected activity when reasonably necessary to address a credible security, legal, or provider risk. Any restriction must be proportionate to the issue and is subject to the notice and restoration provisions below.

AI assists your team

AI features may help draft replies, categorize inquiries, or operate approved follow-up sequences. Outputs can be inaccurate, incomplete, or inappropriate. Review the configuration and material outputs, use human oversight, and provide legally required disclosures when an automated system interacts with someone.

Do not rely on AI output as legal, credit, financial, or underwriting advice. Do not use the Services to make an automated lending eligibility decision or to fabricate rates, approvals, testimonials, or guarantees. Stop or correct an automation that produces harmful or noncompliant behavior, and tell Dash if technical assistance is needed.

Connected platforms and availability

Dash uses third-party infrastructure for CRM functionality, hosting, advertising, authentication, communications, payments, and related features. Dash branding does not mean Dash owns all underlying technology. Your authorized use of connected services may require separately disclosed provider terms or account permissions. We will identify material restrictions relevant to your use; undisclosed future provider terms do not automatically rewrite your commercial agreement.

Ad review, carrier filtering, provider outages, account enforcement, maintenance, and technology changes can affect availability, delivery, or features. No particular uptime, response time, integration, or permanent phone number or subdomain is promised unless your order says so. Dash will use reasonable efforts to communicate and address material disruptions within its control. Changes do not excuse obligations or remedies that your agreement or applicable law preserves.

Ending Services and arranging a handoff

Your service agreement governs term, renewal, cancellation method, and notice. If it is silent, contact Dash to agree on a written termination date and a practical handoff. A support request or website visit does not establish a new minimum commitment. Both parties must account for authorized outstanding charges and remaining campaign funds.

Dash may suspend affected Services for a material breach, overdue undisputed fees, a credible security threat, unlawful activity, or a binding provider or legal requirement. We will give notice and a reasonable opportunity to resolve the issue when practicable. Immediate protective action may be needed if delay would cause harm or breach law. We will explain the reason when legally permitted and restore access once the issue is resolved, where technically possible.

Before access ends, arrange exports, removal of user permissions, ad account handoff, and any supported number or domain transfer. Transfers depend on provider rules and verified ownership; they are not guaranteed merely because a resource appeared in your portal. Dash will confirm applicable retention, deletion, and migration arrangements in writing. Confidentiality, accrued payment duties, and terms intended to survive continue after termination. Nothing here authorizes holding records in violation of law.

Service standards and limitations

Dash will perform its agreed professional services with reasonable care and skill. Tell us promptly about a material failure so we can investigate and provide an appropriate remedy under your agreement and applicable law.

Except for express commitments in your agreement and warranties that cannot legally be excluded, the website, software features, and third-party integrations are provided as available, without additional implied warranties of merchantability, fitness for a particular purpose, or uninterrupted or error-free operation. Dash does not guarantee that a campaign, automation, or compliance feature alone will satisfy every legal requirement. This section does not remove the express service standard above.

Limits that apply to business service claims

This section applies only when these Terms are affirmatively accepted or incorporated into your service agreement. To the extent permitted by law, neither party is liable to the other for indirect, consequential, special, exemplary, or punitive damages, or lost anticipated profits or opportunities, arising from the Services.

Subject to the exceptions below and a different limit in your signed agreement, each party's total aggregate liability arising from the Services is limited to the service fees paid or payable to Dash under the affected order during the 12 months before the event giving rise to the claim. Advertising spend, taxes, and pass-through provider charges are excluded from that calculation. For website-only use without a service order, these Terms impose no fixed monetary cap.

These limits do not restrict liability for fraud, intentional misconduct, gross negligence, death or personal injury where not lawfully limitable, or any liability that cannot legally be limited. They do not excuse payment of authorized fees, return of client funds that are due, or your or Dash's obligation to provide a remedy required by nonwaivable law. A signed agreement may provide different protections for confidentiality, security, or infringement claims.

Responsibility for third-party claims

For purchased Services incorporating these Terms, each party will defend the other against a third-party claim to the extent caused by its own fraud, willful misconduct, or unlawful activity in connection with the Services. A client will also defend Dash against claims caused by client-supplied content infringing a third party's rights or client-directed outreach for which the client lacked required permission. Dash will defend the client against claims that Dash-created original deliverables infringe a third party's intellectual property rights, except where the claim arises from client materials, unauthorized modifications, or use outside the agreed scope.

These obligations exclude the portion caused by the protected party's own wrongdoing. The protected party must provide prompt notice, reasonable cooperation, and control of the defense to the defending party. No settlement may admit the protected party's fault, require its payment, or impose a nonmonetary obligation without its consent, which must not be unreasonably withheld. Recoverable amounts are reasonable defense costs and amounts finally awarded or approved in a settlement, subject to Section 16 and your signed agreement.

Raise an issue with us first

Contact Dash with the relevant order, a description of the concern, and the resolution requested. The parties will try in good faith to resolve business disputes. This informal process does not prevent urgent protective relief, a regulatory complaint, or action needed to preserve a legal deadline.

The governing law and court location in your signed service agreement apply to disputes under that agreement. If none is agreed, applicable law determines them. These Terms do not independently require arbitration, waive a jury trial, shorten a statutory claim deadline, or waive participation in a class action.

Updates, notices, and the complete agreement

We may update these Terms and will show the revised date. Material changes affecting existing purchased Services will be communicated in advance through an account notice or the business contact on file and take effect only as permitted by the applicable agreement and law. Changes do not retroactively change a dispute, authorize a new charge, or override a signed agreement without the necessary assent.

The parties are independent businesses; no partnership, employment, or agency relationship is created beyond the limited authority expressly granted to perform the Services. Neither party is responsible for a delay caused by events reasonably beyond its control, but must take reasonable steps to reduce the impact; this does not excuse already incurred payment duties or legally required remedies.

If a provision is unenforceable, the remaining provisions continue to the extent lawful. A failure to enforce a provision is not a permanent waiver. Assignment of a service agreement requires the other party's written consent unless that agreement expressly permits it. Formal notice requirements in your signed agreement control. These Terms and the applicable accepted agreements form the agreement for their subject matter; no unagreed online policy silently replaces negotiated terms.
